Eric Dane's lawyer says it's a not a sex tape.

Eric Dane's lawyer must have been up really late last night because, from the looks of it, he's been busy sending out cease-and-desists! Eric Dane supposedly got caught in a "sex tape", but his lawyer says that it's a "consensual moment" for Dane and wife Rebecca Gayheart, and basically shamed us if we want to see it. Yikes! I'm blushing.

"Although the participants are nude, the tape is not a 'sex tape,'" Dane's lawyer released. "It is a private tape made for only my clients' personal use, and nobody has the right to exploit it. If anyone exploits the tape, they will be violating my clients' rights and will be exposed to significant liability."

Grey's Anatomy's McSteamy, aka Eric Dane, is shown in some compromising positions with his wife, Rebecca Gayheart, and another woman who looks like Kari Ann Peniche, who was crowned Miss Teen USA in 2002, later losing the title after posing for Playboy.

One Twitter member tweeted "How hilarious is the Eric Dane 3 way sex tape? I'm convinced everyone has a sex tape. There's a lot of anatomy present and it isn't grey." So I guess we're not alone in wanting to see it, then...?

As for the bigger issue at hand, how can we weigh in on this besides say that you should never record anything compromising?! Especially, um, if you are famous.
