Kelly Rutherford Settles Custody Case With Ex

Gossip Girl star Kelly Rutherford has settled her custody dispute with her ex-husband Daniel Giersch. The couple have finally agreed on terms over their two children – at least until April 2010.

Rutherford filed for divorce in December 2008, while she was pregnant with the couple's second child. The actress and Giersch had a heated battle over the custody of their children that nearly kept Rutherford from filming scenes for the hit US series. But settlement documents have now been filed with the court and, under the terms, both Rutherford and Giersch will temporarily relocate from California to New York until April 2010. The Kentucky-born actress will live in New York City, while Giersch will live in the Hamptons. However, neither party can travel outside of New York or California without the agreement of the other. The legal documents also state that both parents will attend co-parenting counselling sessions as they share joint legal and physical custody of the two children.
