Rebecca Gayheart and Eric Dane Sue for Over $1 Million

Rebecca Gayheart and Eric Dane have sued Gawker Media for releasing their nude video with Kari Ann Peniche. The copyright infringement suit is for over $1 million for the 12-minute clip. Do you think that the two have a case, or are they overreacting?

Nick Denton, publisher of Gawker Media, Tweeted the following: "To quote the great Marty Singer – Eric Dane's lawyer – if you don't want a sex tape on the internet, 'don't make one!'"

Singer argued that Gawker was warned prior to posting the sexy clip that they would face legal issues if it were released to the public, but Defamer.com went on to violate the couple's rights by "maliciously distribut[ing] an uncensored copy." The clip showed Rebecca, Eric, and Kari Ann is various states of undress, "behind locked doors in Peniche's bedroom."

Gawker SO knew this was coming, but they probably need the traffic. Zing!
